You have the right to receive free information about the origin, recipient and purpose of your stored personal data at any time. You also have the right to demand the correction, blocking or deletion of this data. You can contact us at any time at the address given in the imprint concerning this and regarding other questions on the subject of data protection. Furthermore, you have the right to complain to the responsible supervisory authority.

Subject of data protection

fount flexibly optimizes the entire job placement and recruiting process. The modular product architecture adapts flexibly to individual needs. The subject of data protection concerns personal data. These are individual details about personal or factual circumstances of a certain or determinable natural person. This includes, for example, information such as name, postal address, e-mail address or telephone number, but also user data, if applicable. User data is data that is necessary to use our websites, such as information about the beginning, end and extent of the use of our website and registration data. Which data is collected by us and how it is processed or used is described below:

Automated data collection

When you access the fount webpage, your Internet browser automatically transmits data for technical purposes. The following data is stored separately from other data that you may transmit to us:

This data is stored exclusively for technical reasons and is never assigned to a specific person at any time. We reserve the right to check this data if we become aware of indications of illegal use.

Is there an obligation to provide data?

The input of data at fount is voluntary and without obligation. You decide which data you provide within the scope of use. For technical and functional reasons, in some cases it is necessary to provide data in order to use fount. The following paragraphs describe which data must be entered.

Which data and for what purpose is your data processed (purpose of processing)

fount as an intuitive user interface takes over the effective job matching: This means that fount users (hereinafter also referred to as "talents"), i.e. those who are looking for jobs, receive job offers from fount clients (e.g. advertising agencies, film production cpmpanies), who are looking for talents for realising jobs.

As far as the consent of the users/talents has been obtained, the user/talent can have future jobs sent to him/her by e-mail or SMS, stating his/her personal data (surname, first name, e-mail address, telephone (optional), place of residence/work, language skills (optional), details of profession).

The data of a user/talent is only passed on to a fount client, i.e. the one who offers jobs, in order to enter the selection pool of potential contractors. Based on the matching process carried out by fount, the user/talent is then informed of a job offer which includes the identity of the client offering the job. The user/talent, if interested in the job offer provided to him/her, has thereupon explicitly consented to the disclosure of his/her data to the client provided to him/her via SMS or e-mail to fount. A revocation of the consent is possible at any time.

Voluntary data for users/talents

fount offers you as user/talent the possibility to personalize your profile. For this purpose you can, for example, voluntarily enter your professional background and knowledge, your education details , job references, address, hobbies, gender, date of birth, interests, telephone number and Skype contact. You can also upload a photo of yourself to your profile. This information is voluntary and not mandatory to register. You should therefore choose carefully which information you enter in your profile as this can possibly be shared with other users and especially clients of fount. During the personalization process of your profile you can answer questions. Your answers help us to achieve better job matching results.

Revocation of your consent to data processing

Many data processing operations are only possible with your expressed consent. You can revoke previously given consent at any time. All you need to do is send us an informal message by e-mail to support@fount.space. The legality of the data processing that took place up to the revocation remains unaffected by the revocation.

On what legal basis is the data processed?

We process the aforementioned personal data in accordance with the provisions of the EU General Data Protection Regulation (GDPR) and the Federal Data Protection Act (BDSG) (new version) as well as other relevant technical laws:

Is there an automated decision-making process?

The data that we collect is used to analyse certain personal aspects relating to you, in particular your professional knowledge, interests and information about your education. This data is used to decide which specific job offers from fount clients (i.e. job providers) are suitable for you. Automated decision-making processes are also used in some cases. The data processing is based on your consent (Art. 6 para. 1 lit. a GDPR). You can revoke this consent at any time. The legality of the data processing operations already carried out remains unaffected by the revocation.

Information disclosure

Generally, your personal data will only be passed on without your expressed prior consent in the following cases:

If it serves to clarify an illegal use of the platform or is necessary for legal prosecution, personal data will be forwarded to the law enforcement authorities and, if applicable, to injured third parties. However, this only happens if there are specific indications of illegal or abusive behaviour. A data transfer may also take place if this serves the enforcement of our terms of use or other agreements. fount is also legally obliged to provide information to certain public authorities upon request, such as criminal prosecution authorities and authorities that prosecute administrative offences that are subject to fines and the tax authorities.

Occasionally, we rely on contractually affiliated third party companies and external service providers to provide services, for example in the areas of marketing (only if you have given your prior explicit consent) and client service. In such cases, information is shared with these companies or individuals to enable them to process your request. These external service providers are carefully selected and regularly reviewed by us to ensure that your privacy is protected. The service providers are not allowed to use the information for any purpose other than that specified by fount. The service providers are also contractually bound by fount to treat your data exclusively in accordance with this Privacy Policy and the GDPR.

Your data may be passed on to clients, i.e. companies such as advertising agencies or film production companies, which offer specific jobs. However, the data will only be passed on after you have informed us of your interest in the job offer, i.e. only after you have given your explicit consent.

In the course of the further development of our business, the structure of fount may have to be adjusted to a changed legal form, the founding, the buying or selling of subsidiaries, or parts of the company or components of it. In such transactions, client information will be transferred along with the respective part of the business. Whenever personal information is transferred to third parties in the scope described above, fount shall ensure that this is done in accordance with this Privacy Policy and the relevant data protection laws.

Insofar as contents or services offered by our clients or other third parties as a function of this website (e.g. chat windows) are identified by their logo and/or name, they are subject to the data protection regulations stated there with reference to the respective responsible body. We do not process any data that is collected within the scope of these contents and services.

Deletion of your data

If your data is no longer required for the above-mentioned purposes, it will be deleted: fount enables the user to receive information about new job offers. Personal data will only be deleted if the user does request it, as s/he will continue to be informed about job offers until that time.

To delete your user account, fount offers you the possibility to send an e-mail to support@fount.space asking for the deletion of your personal data. In this case your profile will be completely and permanently deleted. If data must be stored for legal reasons, it’s processing will be restricted and thus blocked until the final deletion. The data is then no longer available for further use.

Right of access and rectification and the right to limit processing

You have the right to request information about the data we have stored about you. You also have the right to request a correction of incorrect data, to restrict processing and to have data deleted. For this purpose, please contact support@fount.space or by post to the address given above.

Right of appeal to the responsible supervisory authority

In the event of violations of the data protection law, the person concerned has the right to appeal to the relevant supervisory authority. The relevant supervisory authority in matters of data protection law is the State Data Protection Commissioner of the federal state in which our company is based, Berlin. Right to data transferability

You have the right to have the data allocated to you , which has been proceeded automatically on the basis of your consent or in fulfilment of a contract handed over to you or to a third party in common, machine-readable format. If you request the direct transfer of data to another responsible party, this will only be done as far as technically feasible.

Interactive areas

If the websites provide you with discussion forums or other interactive areas or services, including blogs or other areas and services where you or third parties can create, post or store any content, messages, comments, materials or other items on the websites ("interactive areas"), the following shall apply: Interactive areas are of a public nature and any personal information you post may be viewed by others. The way visitors use information on our website is beyond our control. In particular, we cannot prevent users from sending unsolicited messages to you. Content posted in interactive areas may be stored for an unlimited period of time. If at any time you wish to have any content removed, please e-mail us to support@fount.space.

You alone decide which data you would like to share with us. fount is committed to the principle of data economy. However, if you do not provide fount with certain information, you may not be able to use the platform to its full extent.

Contact form

If you, as a user/talent or client, send us enquiries via contact form, the details provided, including contact data, will be stored for the purpose of processing the enquiry and any necessary follow-up questions. We will not pass on this data without your consent.

The processing of the data entered in the contact form is therefore exclusively on a voluntary basis and on the basis of your consent given with it (Art. 6 para. 1 lit. a GDPR) and is generally used for pre-contractual or contractual purposes (Art. 6 para. 1 lit. b GDPR). You may revoke this consent at any time by sending us an informal notification via e-mail to support@fount.space. The legality of the data processing operations carried out up to the point of revocation remains unaffected by the revocation.

The data entered by you in the contact form will remain with us until you request us to delete it, revoke your consent for storage, or the purpose for which the data was stored no longer applies. Mandatory legal provisions – in particular retention periods – remain unaffected.

Cookies

fount stores so-called "cookies" in order to offer you an extensive range of functions and to make the use of our websites more user friendly , especially for authentication purposes. "Cookies" are small files that are stored on your computer with the help of your Internet browser. Cookies do not damage your computer and do not contain viruses. Most of the cookies we use are so-called "session cookies". They are automatically deleted at the end of your visit. Other cookies remain stored on your device until you delete them. These cookies enable us to recognize your browser on your next visit. If you do not wish to use "cookies", you can prevent "cookies" from being stored on your computer by changing the settings of your Internet browser accordingly. Please note that this may limit functionality and the range of functions of our offer.

Use of service providers

Typeform

For registration forms or for users of our websites (i.e. talents, i.e. those looking for jobs and clients offering jobs) we rely on the service of the provider www.typeform.com. Typeform is a service of TYPEFORM S.L. (Carrer Bac de Roda 163, 08018 Barcelona, Spain). Each time you fill out a form on our website, Typeform only collects the information you provide. This data is processed on servers located in the USA and is not passed on to third parties. Intercom as communication medium

In order to enhance the user experience during the application process on our website, we use the service of Intercom Inc. (98 Battery Street, Suite 402, San Francisco, CA 94111, USA; "Intercom") for sending e-mail messages and for live chats. We provide Intercom with your e-mail address and name as personal information. Intercom Inc. has joined the "Safe Harbor" program, which aims to provide a higher level of data protection for non-EU companies. Mandrill for sending transactional e-mails (not newsletter)

fount uses the transaction e-mail service “Mandrill” to send e-mails for the purpose of communication. Mandrill is a service provided by The Rocket Science Group, LLC (675 Ponce de Leon Ave NE, Suite 5000, Atlanta, GA 30308, USA). Mandrill transmits and stores our user’s e-mail addresses, titles, first and last names as well as the content of e-mails. Mandrill offers extensive analysis options on how e-mails are opened and used. These analyses are group-related and are not used by us for individual evaluation. Mandrill also uses the analysis tool Google Analytics and integrates it when sending e-mails, if necessary. Further information about Mandrill and its service Mailchimp and its privacy policy can be found at mailchimp.com/legal/privacy/. The use of Mandrill is essential for communicating with our users.

Mandrill is certified under the US-EU Data Protection Agreement "Privacy Shield" and is thus committed to comply with EU data protection regulations.

Newsletter

In the following paragraph we will inform you about the contents of our newsletter and the associated registration, dispatch and statistical evaluation procedure as well as your rights of objection. By subscribing to our newsletter, you consent to receive information by fount and to the use of your data as described below.

fount offers you a free newsletter service. The newsletter informs you about new functionalities, new advertising campaigns, developments and new members of the fount team. It will also ask you to participate in surveys to make you aware of new products or services or to send you other information which might be of interest to you. Furthermore, we may inform you in the newsletter about offers and products of our cooperation partners.

For the registration to our newsletter we rely on the so-called double opt-in procedure. This means that you will receive an e-mail after registering on our website in which you are asked to confirm your registration. This confirmation is necessary so that nobody can register with a third party e-mail address.

The newsletter registrations are stored in order to be able to prove the registration process according to legal requirements. This includes the storage of the registration and confirmation time as well as the IP address. Changes to your data stored with Mailchimp are also logged.

Mailchimp for sending newsletters

The newsletters are sent via "Mailchimp", a newsletter dispatch platform of the US provider Rocket Science Group, LLC (675 Ponce De Leon Ave NE Suite 5000, Atlanta, GA 30308, USA).

The e-mail addresses of our newsletter recipients as well as other data described in this notice, are stored on the servers of Mailchimp in the USA. Mailchimp uses this information to send and evaluate the newsletter on our behalf. Furthermore, Mailchimp may use this data in order to optimize or improve its own services, e.g. for technical optimization of sending and presenting newsletters for economic purposes to determine from which countries the recipients come. However, Mailchimp does not use the data of our newsletter recipients in order to directly contact them or pass on such data to third parties.

Mailchimp is certified under the US-EU data protection agreement "Privacy Shield" and therefore commits itself to comply with the EU data protection regulations.

Statistical survey and analyses
The newsletters contain a so-called "web-beacon", i.e. a pixel-sized file which is retrieved from the server of Mailchimp when the newsletter is opened. In the context of this retrieval, technical information, such as information about your browser and your system as well as your IP address and time of retrieval, are collected. This information is used for the technical improvement of the services based on the technical data or the target groups and their reading behaviour based on their retrieval locations (which can be determined by the IP address) or the access times.

Statistical surveys also track whether newsletters are opened, when they are opened and which links are clicked. For technical reasons, this information can be assigned to individual newsletter recipients. However, it is neither our nor Mailchimp's intention to track individual users. Instead, the evaluations serve to trace the reading habits of our users and to adapt our contents to them or to send different contents according to the interests of our users.

Online access and data management
In some cases we may direct the newsletter recipients to the web pages of Mailchimp, e.g. our newsletters contain a link with which the newsletter recipients can retrieve the newsletters online (e.g. in case of display problems of the e-mail program). Furthermore, newsletter recipients can correct their data, e.g. their e-mail address on Mailchimp. Also the privacy policy of Mailchimp is only available on their site.

In this context we would like to point out that on the websites of Mailchimp cookies are used and therefore personal data is processed by Mailchimp, its partners and used service providers (e.g. Google Analytics). We have no influence on this data collection. You can find more information in the privacy policy of Mailchimp.

Cancellation/revocation
You can unsubscribe from our newsletter at any time. Each newsletter contains information on how to do so with effect for the future.

Your consent to receive the newsletter via Mailchimp and the statistical analyses will expire at the same time. A separate cancellation of the dispatch via Mailchimp or the statistical analysis is unfortunately not possible.

Legal general data protection regulation
In accordance with the provisions of the General Data Protection Regulation (GDPR) in force from 25 May 2018, we hereby inform you that consent to the sending of e-mail addresses is given on the basis of Art. 6 para. 1 lit. a, 7 GDPR and Art. 7 para. 2 No. 3, or para. 3 UWG. The use of the mail service provider Mailchimp, the execution of the statistical surveys and analyses as well as the logging of the registration procedure are based on our legitimate interests according to Art. 6 para. 1 lit. f GDPR. We are interested in employing a user-friendly and secure newsletter system, which serves our business interests and meets the expectations of our users. If you would like to receive the newsletter offered on the website, we require an e-mail address from you as well as information that allows us to verify that you are the owner of the e-mail address provided and that you agree to receive the newsletter. fount uses functions of the web analysis service Google Analytics. The provider is Google Inc. (1600 Amphitheatre Parkway Mountain View, CA 94043, USA). Google Analytics uses so-called "cookies". These are text files which are stored on your computer and which enable an analysis of your use of the website. The information generated by cookies about your use of this website is usually transferred to a Google server in the USA and stored there.

IP anonymization
We have activated the IP anonymization function on this website. This means that your IP address is shortened by Google within member states of the EU or in other signatory states to the Agreement on the European Economic Area before it is transmitted to the USA. Only in exceptional cases will the full IP address be transferred to a Google server in the USA and shortened there. On behalf of fount, Google will use this information for the purpose of evaluating your use of the website, compiling reports on website activity and providing other services relating to website activity and Internet usage for the website operator. The IP address transmitted by your browser within the scope of Google Analytics is not combined with other data from Google.

Demographic characteristics in Google Analytics
This website uses the "demographic features" function of Google Analytics. This allows reports to be generated that contain information about the age, gender and interests of the site visitors. This data comes from interest-based advertising by Google as well as from visitor data from third parties. This data cannot be attributed to any specific person. You can disable this feature at any time by changing the ad settings in your Google Account, or generally prohibit Google Analytics from collecting your information as described in the "Opposition to data collection" section.

Facebook pixels

Our website uses the "visitor action pixel" of Facebook Inc. (1601 S. California Ave, Palo Alto, CA 94304, USA, "Facebook") to measure conversion. This allows us to track the behavior of site visitors after they have clicked on a Facebook ad to be redirected to the provider's website. This allows the effectiveness of Facebook Ads to be evaluated for statistical and market research purposes and to optimize future advertising efforts. The collected data is anonymous for us as the operator of this website, we cannot draw any conclusions about the identity of the users. Our websites use plugins from the YouTube site operated by Google. The operator of the pages is YouTube LLC (901 Cherry Ave., San Bruno, CA 94066, USA). When you visit one of our sites equipped with a YouTube plugin, a connection to the YouTube server is established. This tells the YouTube server which of our pages you have visited.

If you are logged in to your YouTube account, you allow YouTube to assign your surfing behavior directly to your personal profile. You can prevent this by logging out of your YouTube account.

Vimeo

Our website uses plugins from the video portal Vimeo. The operator of the site is Vimeo Inc. (555 West 18th Street, New York 10011, USA). When you visit one of our sites equipped with a Vimeo plugin, a connection to the Vimeo server is established. This tells the Vimeo server which of our pages you have visited. Vimeo also obtains your IP address. This also applies if you are not logged in to Vimeo or do not have an account with Vimeo. The information collected by Vimeo is transferred to the Vimeo server in the USA.

Google AdWords and Google Conversion Tracking

This website uses Google AdWords. AdWords is an online advertising program of Google Inc. (1600 Amphitheatre Parkway, Mountain View, CA 94043, USA, "Google").

As part of Google AdWords, we use what is known as conversion tracking. When you click on an ad placed by Google, a conversion tracking cookie is set. Cookies are small text files that the Internet browser stores on the user's computer. These cookies expire after 30 days and are not used to personally identify users. If the user visits certain pages of this website and the cookie has not expired, Google and we may recognize that the user clicked on the ad and was redirected to that page.

Each Google AdWords client receives a different cookie. The cookies cannot be tracked through the websites of AdWords clients. Google Web Fonts

fount uses so-called web fonts, which are provided by Google, for the uniform display of fonts. When you open a webpage, your browser loads the required web fonts into its browser cache in order to display texts and fonts correctly.

For this purpose, the browser you use must connect to Google's servers. This enables Google to know that our website has been accessed via your IP address. The use of Google Web Fonts is in the interest of a uniform and attractive presentation of our online offers. This represents a legitimate interest within the meaning of Art. 6 para. 1 lit. f GDPR.

The Webflow CDN provides duplicate data from a website to various Webflow servers distributed around the world. This results in a faster loading time of the website, a higher reliability, protection against brute force attacks and an increased protection against data loss. Most of the elements and the source code of this website are obtained from the Webflow CDN when the page is opened.
